User Agreement
Welcome to the user agreement for ParkHub.com. This agreement describes the terms and conditions for use of the services provided by the Website. You (the “User” or “You”) must read and accept all the Terms and Conditions of this agreement in order to use this website. If you do not agree to accept and be bound by the terms and conditions outlined here, do not use this Website.
The Company may amend this agreement at any time and alert Users to it by a notification on the Website. All amended terms take effect 30 days from date of posting unless otherwise stated. It is advised Users check back periodically to review any changes that are made.
Registration and Eligibility
Registering your information and details with this Website for any services provided by the Website is done so in accordance with our Privacy Policy. It is the responsibility of the User to ensure registration information is kept accurate. If you are under the age of 18, you can use this Website only under the supervision or approval of a parent or legal guardian. If you do not qualify, please do not use the Website. If you are registering as a business entity please ensure that you have the appropriate authority to bind your business to the terms and conditions of the Website. All content on the Website is owned and controlled by the Website or other parties who have explicitly licensed their properties to the Website.
User Information
“Your information” is defined as any information you provide to us in the registration or listing process. Once registration occurs and your account is created it becomes your unique User ID. It may not be transferred or sold to another party.
The information you provide to the Website may include the following:
- User name, address and telephone number
- Email address and fax number
- A credit card number
- Paypal account information
- Information of User’s existing vehicle(s) – year, make, model, colour
- Information on parking spot details may include – location, features etc.
- Information pertaining to desired payment terms and billing cycle of parking spot
- An image (still or video) depicting the parking spot available for rental
- Any other pertinent information that will assist parkingspots.com to successfully market and/or source User’s parking spot
- Additional content in relation to a listing an inquiry or a blog entry
The User’s information and activities must not be fraudulent, false, inaccurate, misleading, in breach of any applicable laws, ordinances, statutes or regulations, be offensive, obscene, menacing, defamatory or harmful. The Company may suspend or terminate your account if you are found to have engaged in any fraudulent, deceitful or otherwise unethical activity in connection with the Website.
Fees and Services
Registering as a User on the Website both in terms of offering a spot for rent (the “Owner”) and searching for a spot to rent (the “Renter”) is free for all listings. We do charge a Brokerage Fee directly to the Owner upon execution of a sale. The Owner is responsible for paying all fees associated with using the services of the Website and any and all applicable taxes for spot(s) being sold. All fees are quoted in the currency of the physical parking spot’s location.
Payment is processed online using authorize.net. As the leading provider of online payment processing, Authorize.net ensures security of card and User information as a top priority.
Linked Sites
The Website is not responsible for the content or routing of Linked sites. Any User considering or actively engaging with these links is doing so at their own risk.
Liability
We do not control the information provided by our Users which is made available thru the site. You may find other User’s information to be offensive, harmful, deceptive or inaccurate. Please note there is also the risk of dealing with foreign nationals or people acting under false pretence. By using this Website you agree to accept such risks and the Website (our parent company, its subsidiaries and joint ventures and all such person’s, directors, officers, agents and employees) are not responsible for the acts or omissions of its Users.
All Users of the Website hereby release the Website, the Company, subsidiaries, officers, directors, employees, agents and suppliers from any and all liability for lost profits or any actual, special, incidental, consequential, direct, indirect or punitive damages, any costs and expenses arising out of or in connection with the Website, our Services or this Agreement (however arising, including negligence).
Indemnity
Services offered by the Website are only available to and may only be used by individuals who have the legal right to offer up property for rent and use as a parking spot. It is up to the individual Users to ensure that these conditions are met.
The Website operates as a portal through which Users can post and rent their legally eligible parking spots in a variety of pricing formats and duration, to interested parties. We are not involved in the actual financial or property transaction between the Owner and the Renter of the parking spot. As a result we have no control over the quality, truth or accuracy of the advertised spots or the Renters ability to pay for the parking spot. While we will strive to ensure the accuracy and legitimacy of parking spot listings, for the Renter and/or the Owner based on the terms outlined in this document, we cannot ensure that a renter or owner will actually complete a transaction.
As the Website is acting as a portal, the Website and its’ employees are responsible for passing the Renter’s contact information over to the Owner as well as from the Owner to the Renter once confirmation is received from the Renter of intent to rent. Intent to rent is defined as a Renter’s click on ‘request this spot’ on the website. By accepting these Terms and Conditions the Renter and Owner are authorizing the release of required personal contact information between the two parties. This is to enable the two parties to connect and finalize their agreement and is pursuant our Privacy Policy.
Because the services offered by the site are those of a portal, in the event there is a dispute between one or more users, the user agrees to release the Website (and our parent and its subsidiaries and joint ventures and all such person’s, directors, officers, agents and employees) from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed arising out of or in any way connected with such disputes.
We will not be liable for any computer virus transmitted through our site.
Any breach of any of the Terms and Conditions listed in this document may result in an immediate warning, suspension or termination of you as a User of the Website. The Company has the right to revoke and refuse a User’s use of the site without notice.
